    Default How To Make The State Follow The UIFSA Laws

    I really need some help here. I have filed my second complaint with the governor's office regarding this matter and am waiting for an answer.

    Missouri is in violation of several of its own child support statutes and more importantly, in violation of the Uniform Interstate Family Support Act. Specifically, they are in direct violation of UIFSA Section 603(c) and all of Section 604 of said Act.

    I consulted a lawyer in Missouri and he agrees with me BUT tells me that existing MO case law is not favorable to my position. I researched Kansas cases and there is case law where Kansas upheld Missouri orders in the reverse situation. I am getting the shaft here and refuse to go down without a fight.

    Can I file a suit in Federal Court, since the state is violating Federal laws that are tied to entitlement monies? If I sound bitter and out for some revenge, I am. I have been treated like a bank for over 10 years, payed out over 250K in support monies and I am sick of being her banker. My children are emancipated under the original order and I am sick of being treated so poorly.

    Any advice would be welcome, please help me. I paid my obligation, enough is enough.

    How much do you want to pay to litigate this? You can ask the lawyer you consulted how much he would charge to "make a federal case of this", but my guess is it would be a lot of money.

    I was just informed by the governor's office that the State is sticking to their guns. I asked verbally which specific statutes they were "hiding behind", and was told I would need to write a letter to Dept. of Social Services.

    Also someone asked if I contacted my Congressman and yes I talked to a staffer and he is mailing forms to file a complaint and was told if Missouri is in fact violating Federal law they will take action.

    I am also considering writing a letter to the Governor of Kansas pointing that Missouri does not recognize Kansas laws even when directly mandated by the Uniform Interstate Family Support Act.

    Please if anyone has suggestions that do not involve litigating this in court please let me.

    You could talk to the media. If they believe your story is newsworthy, a little bad publicity might make the wheels turn a little faster.

    There are organizations that include men who feel they have been "shafted" by the child support system. You might try "googling" for them. I will see if I can provide you with any links.

    Thanks for the support, my concern is that Missouri might consider my case to be a "home state" issue which would mean that they could assert I am obligated to pay on my youngest child until she is 22 as long as she attends college. I payed my obligations under the Kansas order and it sounds "COLD" but my ex turned my daughter against me several years ago and I do not have a much desired relationship with my baby.

    Bitter, indeed, but I have done all I can do, my daughter is now 18 and thinks I am scum, perhaps she is correct. I remarried after my divorce and my wife died of a heart attack in September of 2004. I have suffered enough grief but I am tired of the crap the State is dishing out. Thanks for listening to my rants.
