Can A Non-Citizen Sue For Car Accident Injuries

hello
im in NY and i was rear ended the other nite. i was stopped at a red light and the guy ran into me doing like 40-50 mph. didint even try to stop.
well anyways i did sustain injuries to my knee, neck and back and so did my passanger. i am suing the person but my passanger is not a us citizen. he is here on a expired visa. will they be able to sue with me, they went to hosiptal and doc also. all paper work was done putting my insurence info..
any insight into this?

Your passenger can sue. He should make his lawyer aware that he is undocumented.

ive heard that the other party insurence might do background check's

If you want somebody to tell you that there's no chance that his status will be detected in the course of litigation, it's not going to happen. He can discuss the issue with his lawyer.
