    Default How Do I Avoid Abandonment Charges

    My husband and I are seperating. He will continue living in Maryland, due to his being stationed there in the military. I will be moving back to our hometown in Arizona. He is going to keep our 10 month old son until the end of May and then I will get him in Arizona. Things are going very smoothly so far, but I want to make sure that when the time comes for me to get him in May that he can't say that I abandoned him by going to another state for a month and a half or so. I am going out now to get a job and a place to live and get set up. Once that is done, we agreed that I will get him. My husband is also starting a new job at the end of May and we don't know what his schedule will be like, which contributes to my getting our son then. Is there anything I can do to ensure he can't charge me with abandoment or desertion if he were to change his mind? Thanks

    It's less a question of "abandonment" - you are not proposing abandoning the child - and is thus more one of whether he can claim to have an established custodial environment with the child with you absent from the household. I suggest you plan this with the help of a child custody lawyer.
