    Default Michigan Adverse Possession

    We have an area behind our houses (two adjoining - we own both) that is approx. 540 acres of field and woods. We fenced off approoximately 2 acres of it for a horse pasture. This was about 25 years ago when we did this. We no lomnger have the horses, but the area is still completely closed in, and we maintain it regularly - keeping it mowed and the trees trimmed. I want to obtain this property through adverse possession before it gets sold and something gets built there. From this point, how do I go about doing this? Do I file somewhere? Are there forms? Do I also have to post it publicly that I'm ddoing this? Where, and how many times do I have to post my intentions? Do I have to have it surveyed first? Can I just obtain what I have fenced, or do I have to go further to the next lot line? Please help, and any info is GREATLY appreciated.

    Default Michigan Adverse Possession

    You would be best served by having the matter handled by a local real estate lawyer, who could evaluate the viability of your claim, identify the proper defendants, prepare and serve an appropriate complaint, and handle the subsequent litigation. Adverse possession claims tend to be defended by the title landowner, and it is difficult for most people to litigate this type of claim without a lawyer.
