    Default Texas fence line dispute

    please advise,

    My wife and I just had a survey done of our property for refinance purposes. My new neighbor (6 months or so) noticed the stakes and reviewed his survey and say that his survey show our fence line to be about a foot over in the front and 4.9 ft over in the back onto his property. My survey only shows the fence to be about 3 fence slats over on the front and about 7 on the back. The fence was there when we bought the house and after some phone calls to previous owners, now know the fence is about 15 years old. What rights (if any) do I have. I don't see the need to move the fence for that little amount of space. Please let me know if anyone has input.

    There is no need to do anything unless the neighbor presses the issue. Then you have to decide whether it is cheaper to go to court or move the fence. Bet you can guess the answer.

    I plan on leaving the ball in his court, but unfortunately he was not very nice in his "discussion" of the fence. There is no law in place that would take the age of the fence in to consideration?

    There may be a legal defense to moving the fence, such as adverse possession or acquiescence. But as lwpat suggests, litigation can be costly, and thus it may be better to come to an understanding.
