    Default Help with visitation schedule

    Hi,
    I live in the state of Michigan and I have physical custody of my child. My child's father has every other weekend with her. He also has two days out of the week that he does not commit too. My childs father and I live approx 30 min away from each other. He just recently told me that for now on he will come to pick her up on his scheduled days but I'm supposed to come get her. I didn't agree to this because in our papers it only states that I'm not to leave the state of Michigan without permission or move more than 150 miles away. Now he wants to take me to court and get out schedule modified so that I would have to come pick her up during his weekends. My question is do you think that the judge would allow this? It would be different if we lived more than an hour away. Thanks in advance for all your help!

    I'm not saying you should agree with him, but what in the world does that have to do with your question? That's about relocating the domicile of the child, not driving across state lines.

    If he won't agree to return her, despite past practices, and the parenting time order doesn't indicate who is responsible, you'll probably have to have the court resolve the problem.

    Oh I know...... I was only saying that was the only thing as far as what was agreed on when it came down to address change or where each of us lived.

    In many detailed parenting plans both parents share the responsibility of transportation. In some plans if one parent had no means of transportation they would have to reimburse the other parent for mileage. If he were to go back to court it is possible that the judge would allow it.
