Who is the child's legal guardian now? His parents? Are they willing to transfer guardianship to you? In other words, what situation exists that a court would even consider giving you guardianship rights?
If he is domiciled in Texas, absent unusual circumstances which you have not described, California has no jurisdiction over him and you would have to file in Texas.
his mother is his guardian,but he lives with his grandmother. I had temp custody when I lived in texas but when I moved to california he didn't want to leave his friends and family. His mother will give me guardianship.
