    Default Back to Work in Michigan

    My fiancee was unemployed for about 5 months. He went to court and had his child support reduced based on his unemployment earnings. He has finally found another job earning much less than he used to. He has the support order based unemployment earnings. Is it his ex's responsiblity to go back to court for support modification based on his new earnings? Once the FOC is notified, will the support be retroactive to his date of employment or the date that it is filed?

    Either party can petition for modification. Absent highly unusual circumstances, such as fraud, modification will only be retroactive to the date the petition is filed.

    So unless she goes back to court, the support based on unemployment earnings is all that he is legally obligated for? Thanks!
