    Default PA DOT Restoration Mix-Up

    Pennsylvania law 1532b.

    I was convicted of two DUI's in 2001 while I was underage. I have completed all of my resoration requirements as per my court order. I have just now completed (last month) paying off my HUGE court fines, costs ect. I sent in everything as completed as per my restoration papers state. I also do NOT own a car in the state of PA (to own a car in the state of PA you need a drivers license and insurance, you can't get insurance without a license). PennDOT is now stating that since I do not own a car so therefor can not put the interlock iginition system on then they are going to suspend my license for another year!!!!! I only had a suspended license by court order for 2 years and 30 days. But I have gone almost 5 since it took me so long to pay the fines (last thing I had to do). NOW THIS! They say it is vehicle code 1532b. Is this correct? Lawyers want almost $1000 to look into this. I just got done paying thousands to get my life back! PLEASE HELP!!!

    Thank you for your reply. I just don't how it can be that I am getting punished for not owning a car. I have been with out my license for 5 years now and PENNDOT says that my credit date only starts when I pay my fine off. So the suspension only began last month. Does anyone else find this screwy?

    Did you read the "Webmaster Note" at the bottom of the link in Mr. KIA's post? It would seem a violation of the Turner case for PennDOT to wait 5 years before imposing the suspension. Also, if they just started the suspension a month ago, did they send you a notice of that fact? If not, they may have violated Warner, another significant PA case.

    If I were you, I'd call the clerk of the Court of Common Pleas for your county and ask what you need to do to get a hearing scheduled on this issue. You will need to serve notice of the hearing on PennDOT (the clerk may be able to tell you how to go about that, as well). An attorney would be the easiest way to go, but if you want to do it yourself, that would be as good a starting place as any.

    Sorry, I have no real expertise in PA law -- but, I can tell you, you'll have to do a lot of research to do this on your own.
