Arrow Wife's Liability on Student Loan Default
I defaulted on my student loan like a stupid idiot. I am trying to make a schedule of repayment but they want a tax return. Problem is I file with my wife and its my debt and I dont want her to be punished for it. We are not connected in any way financially because of my bad credit. I also have worked for 6 different companies just last year. I am a 1099 and not an employee so can they still garnish my wages? I know they can take our tax return if we get one. Is she at all responsiable for my student loan before we got married? Can they garnish her wages or just mine? I live in California and am trying to get information about my rights and how to fixing the problem.

They will take your return and mail your wife a letter with instructions on how to reclaim her portion of the refund as the "injured spouse" . They cannot garnish her wages but I am not sure about yours
