Unhappy Hemar Insurance Corp
About 4 years ago I received a ltter from a collection agency claiming that I owed a debt on a loan taken out from Hemar Insurance corp which was later purchased by Sallie Mae. I checked all my records and credit reports and contacte Sallie Mae and could not find any such record. In addition, all of my other student loans are currently in good standing. I also have a letter from Sallie mae stating that my loans with them have been paid off.

I sent a letter back to the collection agency requesting a verification of the debt and nothing was ever sent back. Well every year thereafter i have been getting the same letters re the same matters but from the 4th different collection agency. In addition Hemar is no longer in business. I have disputed the debt 4 times and nothing has been sent. At some point don't you think that if they had a case they would have pursued the matter?

I am assuming they are trying to get me to admit to having the loan but i don't have any recolloection of anything being out of the ordinary.

Do you think that the reason it has gone from agency to agency is that there was a statue of limitations issue. I took out my first loans in 1986. thank you in advance for your response

From what you say the debt is not claimed to be about student loans, but relates to your debt to Hemar Insurance Corp.

The statute of limitations will depend upon the age of the debt, the type of debt (whether or not it is a guaranteed student loan, for example) and state law. Laws are different in each state.

Thanks for your reply.My understanding is that Hemar Insurance Corp Used to act as a servicer for student loans like law access loans. when I initially received the first notification 4 years ago, i contacted the collection agency. the gal over there told me that legally i did not have to pay this loan back but i had a moral obligation. i told her to send me verification of the debt because i honestly had no idea what she was talking about but she never did.

as to whether it was a guaranteed student loan, i don't know think so because all of my guaranteed loans were consolidated. i don't know if hemar is or was a guarantor the age of the debt would be more than 10 years old and I live in california

In addition, in their letters they keep claiming that they can report this as a negative mark on my credit report. can they do this even if the debt was older than 10 years and should i continue to respond to their threatening letters???

Unfortunately, without more information, I don't know enough about the loan to opine as to your rights. Perhaps somebody else here will have experience with a similar circumstance, and be able to share their thoughts.
