Question Which State's SOL Applies
I have a credit card debt with Providian which I acquired while living in Alabama. The last date of activity on the debt was 2000. The sol in Alabama is 3 years. I now live in Iowa and am being sued by a Phoenix Recovery Group.

My question is, did the sol start over when I moved to Iowa in 2002 or do Alabama's sol still apply?

you didn't restart the SOL by moving, but since Alabama's SOL had not yet expired when you moved, you would now fall under the SOL for Iowa. it still began running in 2000.

This is what I read somewhere....

"..... that regarding items such as unsecured credit cards, the SOL applies to where you are a current resident. With other debt, such as bank loans, etc, it is the place where they were made."

I hope the above is correct.

There's a danger in trying to apply such a general statement to any specific facts, as exceptions may apply.
