    Unhappy Third Degree Felony Expunction in Texas

    Hi,

    I am currently on probation for a 3rd degree felony theft conviction for which I took a plea bargain. In reading through the various legal documents, it appears I am most likely not going to qualify for an expungement or pardon. My probation is seven years. Can I apply for a non-disclosure or seal of records after my probation is complete and, if so, how long do I have to wait to make that filing? I am a single mother with two children and need to have some sort of non-disclosure so that I can obtain employment to support them and find a place to live. Just want to know if I will even be able to qualify for a seal or non-disclousre based on a 3rd degree felony which resulted from a plea bargain.

    Even with expungment, the felony will still be something others can find. Expungement does very little, honestly.

    You won't be able to expunge it but if you received deferred adjudication (a type of probation) you can petition the court to seal your records (in most cases). However, you have to wait 5 years after you complete the deferred period before you can apply.
