    Default Obvious Illegal Judicial Misconduct in Texas

    Can the judge, and or the city or county be sued. My criminal case 2nd on docket when visiting Judge was assigned to court. Following day my attorney moved for recusal on grounds she would not be impartial due to the acrimony between judge and herself. Went in to take plea bargain, found out at that time a restitution being decided, we could not appeal but had to live with. I declined offer. Judge did not provide me with an opportunity to explain reasons for my decision. Instead, she repeatedly accused me and attorney of trying to play tricks on the court and revoked my bond for rejecting offer, remanded me to county jail pending trial. This act is clearly illegal, when normal judge returned on Mon, I was released.

    File a complaint with whoever disciplines judges in your state.

    Done...but that is irrelevant to my question about the lawsuit. Common sense should tell anyone to file a complaint right away. The problem is, filing a complaint against any government entity is completely useless and a huge waste of time. No one ever responds, replies, calls, or even acknowleges that I ever put in a complaint. I took my 12yrs old daughter to Leage City Police Dept to file a complaint against her theatre arts teacher who was feeling up the girls in the class. They never called me back, and still to this day have not. If it were their kid I bet they would. They are all corrupt and above the law and unfortunately stick together. The incident happened on Fri, and judge knew I couldnt get out until Mon. I was supposed to pay my light bill on my way home from court so they wouldnt disconnect. Yeah right! I ended up have to pay more money because of the disconnect. That Nazi judge cost me about $1500 in connect fees and lost wages and they run around doing whatever they please because they cant get sued. If you are in a courtroom and the judge orders you to **** a donkey, you pretty much have to do it or you are in contempt of court. It almost seems that lawyers are about a step behind the government, make that half a step.

    To find out if you have a case, speak to an attorney. Slinging insults at the only person who had thought to provide you assistance is pretty much going to keep everyone else from concerning themselves with your situation. With that attitude, you can expect additional sanctions from the courts.

    Judges are basically immune from a civil suit (the doctrine of judicial immunity). Generally speaking, in addition to filing a complaint with the agency that oversees conduct of judges, you can file a motion in the case to have the judge recuse. If the judge grants that motion then another judge will be assigned to the case. If the judge denies that motion then you will have grounds for an appeal or perhaps some type of extraordinary relief to a higher court.

    In your specific situation since the attorney made a motion for recusal which was denied you should talk to the attorney about an appeal of that issue and any likelihood of sucess regarding the appeal.

    CDWJAVA...Butch up a few notches. I am sick of the entire system and their one-sided ways. As I stated before, and judging from your post, all government employees will cover each other, even in the worst possible scenarios. Disgusting! If the whole circus of a system is immune to lawsuits, wouldnt that incline them to behave however they feel. So, you know what, so do I! If you cant beat them, join them. I do whatever the f*&k I want, and will keep doing whatever the f*&k I want. His post was irrelevant and stupid, and was in no way trying to help me. He was trying to make me look stupid, as most men do who think they are superior to women. If thats the best advice I can get here, I should find another site that actually has some members that know something and can read and understand a post. Maybe I should type slower. Peace out!
