Statute Of Limitations On Credit Card Debt in Washington State
I recently received a Summons for an old credit card debt. It has been over 3 years since my last payment to this card company (last payment was on 7/25/01). My memory isn't the greatest but I don't believe i have sent or said I would pay any money since this time. I live in Washington State and the SOL for a open-ended debt is 3 years. In the Summons they are trying to use the 6 year written Statute Of Limitations. I sent a Filed reply to the District Court and the Law firm handling the case and I'm waiting for their reply. In my reply I stated I would be using the 3 year open-ended SOL in my defense. There are many many thousands of dollars involved here and I really need some help. iT WILL DESTROY ME IF i LOOSE. What do I do next??? I'm sure this will go to trial soon. HELP!

Make sure you preserve the statute of limitations issue in your answer and affirmative defenses. Raise the issue in court through a motion, and the judge will determine which limitations period applies.
