    Default Backing up and got hit at parking lot

    Today I was in a fender bender, in Thornton Colorado.. It was in a safeway parking lot. I was just leaving, looked behind me and seeing all clear behind me I started to back out. part way out of the parking spot I then saw a truck in my rear view mirror I slammed on the brakes came to a stop and he ran right into my rear bumper. It did do damage to my rear bumper driverside to where it should get fixed due to the paint is now flakeing due to the impact. His truck came away with just paint damage my paint on his bumper. The cops came and gave me a ticket.
    1. On that ticket I did not have my insurance card, which I called my insurance company at the time and advised them of that. They stated to get a Fax Number and they can fax proof of insurance. I advised the officer of that and he said not to worry about it. So I have to go to court to prove that I had/have insurance on a certian date which they gave me.
    2. On that same ticket he cited Sec. 1211 charge backed vehicle in parking area when unsafe. 2 points off my license com. code 153. which is another reason why i have to go to court.
    What the heck Why did I get a ticket for the 2nd one? It was not my fault I looked nobody was behind me I went. If they are blaming me the insurance company then will not get my car fixed?? any help or advise would be greatly helped..

    an insurance componay can determine who they believe is at fault and act accorrdingly unless a court orders differently. Getting aticket oes not help your case though.

    If you believe you are not guilty of the ticket, then contest it in court.

    Without seeing exactly what happened, it is impossible to determine who is at fault. It does sound as if you did have some responsibility for the accident though. If the truck was driving down the lane and you backed into his path and he was not able to stop before hitting you, you are going to be held responsible.

    With him being in the lane, he would have right of way and unless you can prove some reason it was his fault, it would appear to be your fault.
