Question Credit Card SOL in California
I live in California.

I'm being sued for a credit card debt that was charged off. My last payment on the account was September 2002. I am in the process of writing a letter asking for validation and fully expect that I will have to go to court.

May question is, does the statue of limitation begin when I missed my first payment or when the credit card company started collection activities against me?

It runs from the date of the breach, which would typically be the later of the date of the last purchase on the account, the date of the last payment, or the date payment was due following the most recent purchase. The exact rules can vary by state.

Thanks Aaron. After reviewing my records, it is still over 4yrs using any one of those dates.

Check out the California Statute of Limitations for credit card debt. It is very short, 4 years from the date of a last payment on the account. I think they have to file suit against you before the 4 years is up, which would have been in September of 2006. Trust Aaron, he is a genius.
