Discussion of Credit Card Debt with Third Parties, in Indiana
Hi,
Need some help. Does a CC company or a Law firm have the right to discuss a debt collection with a person who is not named and the account? This just happened and i feel mad that they would discuess my personal info with someone else. Any help would be great.
Thanks,
Bill

Re: Discussion of Credit Card Debt with Third Parties, in Indiana
The key portion:
Quoting May a Debt Collector Contact Any Other Person Concerning Your Debt?
|
A debt collector may contact a person other than the debtor only to discover or verify the debtor's location. The collector must: - identify himself, but he must identify his employer only if expressly requested to do so;
- not reveal the consumer's indebtedness to anyone other than the debtor or his/her attorney;
- not use a post card or in any way reveal debt collection activity.
The collection agency may contact any person besides yourself about your case only once. If a collection agency bill collector calls a third person more than once, they should warn the collector not to call again or they will complain to the Federal Trade Commission.
|
Note that in-house collection efforts are not ordinarily covered by the FDCPA.

Re: Discussion of Credit Card Debt with Third Parties, in Indiana
Well i got a letter from Phillips & Cohen stating they were retained by Chase bank to recover the debt. Turns out that the office that called said it was a law firm and its listed as a collection company. This only gets better i tired to call and just get names and address to submit a complaint and they would not give it up. So i called Chase to see if they could help. Talked to 5 people in 5 different departments and not one knew who set this up. Also the amount that was owed keeps changing. I have drawn up the validation letter.What else should i include? Can i put a copy or statement saying that i have filed a complaint with the FTC and Att. general?
Thanks,
Bill
