just to debate and self educate....

but if the customer owns the songs, wouldn't the "fair use rights" of the ownership allow them to use the music they own on a video they own.
    regardless who creates it?

if i have no tape recorder..and you do,...and i buy an album..and give you a blank cassete...and ask you to copy it for me so i can listen to it in my car...

just because you did the labor doesn't mean i don't still own the music that i have fair rights to.

    eh? or nay?

Fair use doesn't give a third party the right to duplicate a copyrighted work and incorporate it into a commercially produced product. Nor would such a copy be a backup copy.

its mine i own it. i have fair use rights and i want a song from the album i own to be on my wedding video. its not a commercial video its my private wedding.

where does fair use rights say you have to back up copy the whole album?

no argument..no disrespect...just asking for more info here

    thanks.

would things be different if i made my own video?

Default Re: Why Can't I Make All The Copies I Want When I Own An Original?

my posts pertaining to "Using Copyrighted Music in Wedding Videos" were extracted and morphed into a new thread?

i don't know who put up the title here but the answer is that you can only make one back up. (i asked about specifics of if i need to do an exact duplicate or if i could select just my favorite songs and if i could use them in a self produced or commercially produced (but for private viewing) video of a wedding.

the discussion was about the proper legal ways of including music in wedding videos. it was not a generic copyright question such as stated in the new title here.

questions pertaining to the original thread were things such as
does it matter if you hire someone (ie a third party)

i guess my question was to complex as a multi-part?

so far i have found the following info. it specifies a training video but a wedding video could be seen in the same parameters.

Can I use a little bit of protected music in the training video I'm doing for my boss? Can I use it in my personal videos?

    Maybe yes, maybe no.

First of all, it must be understood that copyright laws are deliberately vague. It is in court that the law is tested and clarified, and precedents are set for future cases.
We now know that "permitted" use of protected works by an individual is different from that of an organization (company, club, etc.) and even then, it depends on the intended use. For individual use, if the work is not intended for broadcast in the general meaning of the word, there is usually a degree of tolerance, and in some countries it is clearly permitted.
