    Default Voluntary Repo on a Car

    Hello, everyone thank you for reading my question.
    I live in california. I Return a car to the dealer that i was leaseing because it was leaking transmission fluid baddly.

    The Car is a 2006 and has only 9,000. I call the dealer to notify them of this problem and they told me to send it to them. I am upset because I had to pay for a towing truck from my own packet and the dealer didn't even offered me a loans car during the time my car was in their shop.

    Now they are calling me to pick up the car, but I already talk to their bank and notify them that i din't want the car back, they told me that they were going to take this action as a voluntary repo then. My question is, can i go to jail for this action, or can they sue me, I don't have any assets or much money in the bank, and definately I don;t feel safe driving taking that car back. Please advice me.

    Voluntary repo will trash your credit.

    Voluntary repo will not get you out of making up the difference in what you owe vs what car is sold for.

    Yes, they can sue you for this difference.
