    Default Ticket violation reads "Speed in Zone"

    Recently my daughter was pulled over by a Town Police Officer in New York Orange County). To the best of her knowledge she had not been doing anything wrong, but politely allowed the officer to give her a ticket. When I looked at the the ticket later it stated for the violation "Speed in Zone." There was no notation of how fast she was supposed to have been going or what the posted speed limit in the zone.
    I instucted her to plea "not quilty" and mail the ticket in and be assigned a court date. My question is, what legal grounds would she have for fighting this ticket? It would seem to me that the officer's failure to clearly identify the violation (i.e. 45 in a 30 mph zone) and simply state a vauge "Speed in Zone" charge should be dismissed by the judge. Is "Speed in Zone" a valid violation?

    Was there statute or ordinance cited on thr ticket? Could it have been a construction or school zone?

    When she mails it in she needs to check the box on the back requesting a deposition. Be sure she keeps a copy and sends the ticket CRR. They are only allowed so many days to respond or you can motion for dismissal.

    There is a section on the ticket checked that is titled "other law" and it has this number written in: 74.3

    The area where she was stopped had no special zone - school, work or otherwise - and there were no adverse weather conditions.

    Probably a city ordinance. If you both show for court you probalby can get it reduced to a parking ticket that will not show on her record.
