Recently my daughter was pulled over by a Town Police Officer in New York Orange County). To the best of her knowledge she had not been doing anything wrong, but politely allowed the officer to give her a ticket. When I looked at the the ticket later it stated for the violation "Speed in Zone." There was no notation of how fast she was supposed to have been going or what the posted speed limit in the zone.
I instucted her to plea "not quilty" and mail the ticket in and be assigned a court date. My question is, what legal grounds would she have for fighting this ticket? It would seem to me that the officer's failure to clearly identify the violation (i.e. 45 in a 30 mph zone) and simply state a vauge "Speed in Zone" charge should be dismissed by the judge. Is "Speed in Zone" a valid violation?
