    Default Lawyer's Drug Use As Grounds For Ineffective Assistance Claim

    ATTONERY ACCUSED OF TAKING METH AS PAYMENT

    My attorney is facing 4-12 years in prison. His office phone number has been disconnected. The problem is that I am looking to get my records from him for a F5 charge that I got in 2001. I am trying to get a felony pardon. I have almost 35 letters of reference and character. I have held the same job for over 9 years now, prior to my conviction I graduated from the police academy, and I was awarded custody of my 2 girls during my divorce. Does a pardon seem out of the question, am I wasting my time?????? The DA offered my a misdemeanor if I did 60 days straight time or 6 months work release. I could not accept that because I had my 2 girls to take care of...So now I have a class 5 felony menacing charge on my record.... can I do anything about my lawyer being a druggie???? Maybe he did not represent me properly

    Unless you can demonstrate that the lawyer's representation was inadequate, the fact that he used meth is irrelevant to your situation. From what you say, your present predicament results from choices you made, not from anything your lawyer did.
