    Default Advice from an attorney to avoid being deported

    this was my previous thread
    hi, i really really need help
    we came from thailand at a very young age with tourist visa
    and we have social security that says "Not valid for working"

    ok last two months my bro was arrested for shoplifting (in Burbank, California)
    and everything was going fine until the PROBATION NOTICE was sent in my mailbox, they're asking for citizenship proof, or green card and we DO NOT have any of those papers
    and i dont know what to tell them, im afraid that my bro will get deported to thailand, if he does get deported, can he come back to US in the future?
    im praying to God everyday to not get deported

    ok the attorney said that I should get my brother a proof from school, saying that hes a student and just admit that we dont have papers but say that he's a student
    is this a good idea?

    I doubt that anybody here is going to second-guess your lawyer. If you truly do want a second opinon, consult an immigration lawyer.

    Without second guessing your attorney's advice, a mere statement and proof that he is a student will not change the situation. It is important to know whether he benefits from section 245(i) or if he gets married (good faith marriage), he can then possibly avoid removal. One needs to analyze if he is eligible for cancellation of removal. Your criminal counsel needs to try to vacate the conviction too. You need to consult with an immigration attorney and have him review all your brother's documents.
