    Default Criminal Trespass in Texas

    two sons were playing tennis and decided to take a dip in the homeowners association pool (which was closed). Another youth playing tennis phoned the pool management company and the one of their employees came to the pool with an officer. The officer was not going to make an arrest but the manager wanted to press charges.

    Question? Whos the plantiff? The County (transferred to county jail, arrested by city police) or the Pool Company?

    What if pool company agrees to drop the charge. How do you go about doing that.

    "The people" are the named "plaintiff" - at whatever level the charge is brought (State / County / Township / City).

    They would contact the prosecutor's office and indicate their desire to drop the charge. In most jurisdictions, save for certain crimes such as domestic violence, a misdemeanor charge can only proceed with the consent of the victim. (Felonies charges may proceed regardless of the victim's desires.)
