Default Workers' Comp Settlement
hello again, ive posted once before and got some good feed back, im here again....just to inform u, my husband has been on workers comp since july of 99--6 surgeries later....we are gettin ready to settle....for the last two years my husband was gettin ssi benefits to help compensate for the back and forth game the insuance co likes to play called your ttd, then your major perm partial....anyway, i was wondering, ssi has deemed my husband disabled and pays him monthly benefits, now the insurance co says he is not......the rating was done by our lawyer and they have come up with 34 1/2 percent...which in CA, (thank u arnold) is only about 25 thousand dollars, to me and my husband who is not stable mentally because of all this......not fair, not fair at all, and our lawyer says its the law...we dont have the right to tell them what we think or what we feel is fair....arrgggg it just kills me....my husband will never be the same........we will nvr be the same...what do ya think? thanks from california

You are correct that under Gov. Schwarzenegger the California workers' compensation laws were amended in favor of employers. (Although the legislature has to share the responsibility for that change.)

I am sorry that you haven't found the system to be more fair.
