    Angry Judgement of Foreclosure Amount Different Than Payoff

    I had a judgement of foreclousure entered by the courts of Seminole County Florida for one amount and 2 weeks later sold the house. When I went to closing I was informed my payoff was 8,000 more than the judgement. The closer told me I could dispute this after closing with the finance company so that closing could continue and I agreed.

    My Question is.....if the judge and the atty's for the finance company said one amount at the hearing, can the finance company keep the extra I paid? How do I handle this? They have sent one check for 465$ and today told me another for 998 was on the way....I haven't and won't cash either of them until I know how to deal with this judgement and payoff difference.

    I don't understand the difference at all and that is why I am fighting with the finance company.....I wouldn't think once the judge issued the order the company could demand differently.

    And yes....In Florida I can sell the house all the way up to auction to settle the judgement.

    The judgement was for 128,500 via the court...when I went to closing 2 weeks later the title company told me that the finance company told them the payoff was 135,000. I'm pretty sure the 135 was the payoff loss mitigation quoted me 2 months prior.

    I just don't understand how they can make me pay a different amount than the what the judge ordered.

    All we can do is guess. For example, you may have contractually agreed to pay certain fees, costs, or expenses associated with foreclosure above and beyond the amount of the judgment. Consider taking all of the relevant documentation to a local lawyer, to get help trying to figure out what is going on.
