    Question Emancipated at 16 in Colorado

    I know you are all very critical of us teens who want to be emancipated, but I felt I should get some advice anyway...
    I live with both of my parents and a younger sister. My older sister used to live with us as well, but she left when she was just 16, the age I am now. My dad drinks, a lot. He's always yelling, and sometimes, he gets physical. He was worse with my older sister, and he's only gone as far as to push me and grab my arm when I tried to walk away. I have tried to get help from therapists, my mom, and the school counselor, but they all suggested the police and getting me removed and put in foster care, neither of which I want or need. I am fully capable of supporting myself, I have a job and over a thousand dollars saved up. I live in Colorado, and I want to get away from my dad and the depression his yelling keeps forcing me into (doctors have proven that I have it, and it is because of an unstable environment at home).
    I am afraid of my dad, and worried that I might upset him and cause an unecessary act of violence on either his or my part. I need to get out of the house I currently reside in, but stay in the town where I attend school and work. Can I do this in Colorado? I have no other relatives, and no other place to go where I could keep my job, friends, and school. I have my mother's consent but not my father's to be emancipated, but I am not sure if it is the right decision for me..... Any advice?

    Not all of us are critical. My approach is generally to post the law as it relates to the inquiry, and leave it at that.

    Colorado does not appear to have a statutorily defined procedure for emancipation. It recognizes emancipation in its statutes:
    Quote Quoting Colorado Code 19-1-103. Definitions
    (45) "Emancipated juvenile", as used in section 19-2-511, means a juvenile over fifteen years of age and under eighteen years of age who has, with the real or apparent assent of the juvenile's parents, demonstrated independence from the juvenile's parents in matters of care, custody, and earnings. The term may include, but shall not be limited to, any such juvenile who has the sole responsibility for the juvenile's own support, who is married, or who is in the military.
    It thus appears that a Colorado court will recognize a minor as emancipated, but without a statute it's difficult to suggest the procedures; you may wish to inquire with your local court to see if there are standard forms for petitioning for emancipation.

    I doubt this statement is true. the above mentioned person are required by law to report abuse! If youhad told anyone of these person then CPS and/or Police would be investigating and talking to all persons in household and if abuse was correct minors would be removed from home! You also say your capable of supporting yourself! do you have a job? does it pay enough to support yourself 100%? There are many other factors its not a simple process. If there is abuse in the home the best thing you can do for yourself and sibling is report the abuse! You may not be removed from home but CPS will investigate and you could get the help (whole family) required to mend the relationship. CPS does not split families its CPS goal to unify famlies!

    In my opinion, most of us that reply are realistic, and that may appear that we are being critical.

    In many cases, the poster will read a reply where someone has pointed out that their situation is not an emancipation case, but a case of child abuse/neglect (and should be reported); that isn't the answer the poster wants to hear.

    I agree Happy people come here to hear what they want but that isnt what site is about. You ask a question you get answer (refers to sig line) You ask for answers you get it and abuse should always be reported

    Well, whether or not you believe this is true, I did in fact tell everyone I stated above, and they put my dad in counseling, but after a month he stopped going, and they let him stop, claming he was 'okay' again. He has never hit or slapped me, so there's nothing there. And yes, I can fully support myself. I already pay my own insurance, I buy my own food, I pay rent to my parents, I buy my own clothes, etc.
    Oh, and even if I were removed from my home, at 16, a foster child is legally emancipated. So, that wouldn't really matter.

    Where on earth did you get the idea that a foster child has legal emancipation? If you're in foster care, you're hardly living independently.
