My home was bugged without my knowledge

my brother in law put a voice activated tape recorder in my library when he was a guest in my home. he did this without the knowledge of myself or my husband but disclosed personal conversations i had in that room with my husband shortly thereafter. i feel raped and violated and my fury is something that i know i will never get over. my husband is put in a terrible position because he understands how i feel but feels torn because they are his family. i have vowed to never allow them into my home again and this argument is catching so much steam that i have seriously thought about contacting a divorce attorney to remove myself from such sick people. although my husband is an innocent victim in all of this it is something he will never stand up to them about and i will never ever let it go. we are in the state of new york and i believe that the law states that one party must be aware of the taping for it to be legal. is this a criminal case?

New York criminalizes eavesdropping:

It is a crime to overhear or record a telephonic or telegraphic communication if one is not the sender or receiver, or does not have the consent of either the sender or receiver. It also is a crime for someone not present to overhear or record any conversation or discussion without the consent of at least one party to that conversation.

so this is something i could have him arrested for?

If he broke the law, which your posts suggest that he did, then yes - if you were to file a police report, there is a substantial chance that he would be charged with a crime.
