Hi, I rent an apartment in a duplex in California. I received a Three Day Notice to Pay Rent or Quit from my LL today by mail. It was sent by CRR on Saturday, January 13 and I received it on January 16. I fully intend to comply but the notice states that I have to pay "on or before January 17". Since I just received it and was therefore just "served", don't I have until January 19 to pay? I called him to try to explain that because I had just received the notice, I would not be able to pay by the 17th but he never returned my call. I will send the check overnight so that he receives it on the 18th but can he refuse to accept it and then continue with the eviction process? There was no notice posted or any attempt to deliver the notice personally, just the letter.
Also, in the event that he does file an unlawful detainer and I have to go to court, what would be the impact if he included a late fee in the total amount and that he did not include the names of both tenants on the lease (just myself)? I just want to pay and get this behind me without having him pursue an actual eviction. What can I do at this point? Thanks for your assistance.
