I was taking a friend of mine who was had surgery to home as fast as possible as he could not sit in car properly. We came to a sign where it changed to i think 45mph. As I passed the sign I was going 45. When pulled over, the officer claims that I was like 50 feet before the sign when he clocked me on radar. Can this really be held up. I am contesting it and have filed a not guilty plea. I can always change, but I was planning on meeting with the solicitor discuss a plea negotiation to have it changed to non moving violation along with fine and court costs, but I don't know if they will accept. Right now I am scheduled for a bench trial, but if there is no agreement made, I am going to motion for a change to state court and jury trial. What all should I do to prepare and how good of a case do I have. This is in the state of Georgia in Athens-Clarke County Municipality. I figure I can get the jury on my side, but I don't want to take it to that point. Any and all advice welcome.
