Federal Drug Smuggling Charges

Hello everyone I am currently back from Leave in the Military and have gotten the worst news possible...I am in need if advice and what to expect.

1. My sister was coming in from Juarez, Mex. after visiting my parent whe was using boyfriends truck to get accross..she is 24 years old....she was sent to secondary inspection and was caught with drugs..I have not been able to get any information becuase I am in California and am utlizing my parents to get information so I can reseach and find out they can't afford an attorney so she is getting a public defender...they did not know she had a bail amount and it was to late to get her out of jail $1500.00 court date is monday and I need to know what she is facing please help me I am so stressed out becuase my entire family has placed the responsibility on me to find out...can someone help...this is her 1st offense. she is mother of 3 children

We can't guess at what she might be facing, without knowing anything about the drug, the amount found, or the charge filed.

Called my parents and they will be allowed to see her on Saturday..and they should have details court date is this coming monday..I am praying for here sake that she will not have to do time.....my parents are completely overwhelmed with disbelief becuase we were not aware of her involvement with this boyfriend of hers and to top it all off she is 3 months pregnant and she has been in custody since 06/21/05.

After talking to my parents and getting news from all family members they were finally granted permission to see my sister the following is what information I received by my parents;

1. 116# of Marijuana in a truck
2. Offense: possession
3. No court date yet she has been in custody since June 21st
4. She has been appointed a public defender (Female)
5. My parents finally got all 3 of her children back from the boyfriends parents home...Boyfriend nowhere to be found he is somewhere in Mexico.

What will she probably face?

Jail time? if so how much time approx?

probation?

I am aware that you do not know exactly but what does someone with this type of offense...what do they probably get?

That depends upon what she is charged with, the terms of her plea bargain (if she chooses to enter one), and the recommendation of the probation officer. You suggested that she has a lawyer - her lawyer is the person who is presently in the best position to estimate a possible sentence.

This is the first time I use this. So forgive me if I am posting the wrong way. I have a similar situation. The only difference is the person I have a question has federal cocain w/intent to distribute. In addition fleeing to another country.
Once the court is over & done with on the case, how long if ever before he
can return to the country. This is his country of origin.

This is a federal charge? It's going to depend on the conviction charge, underlying facts, and immigration history. Probably at least ten years; possibly a lifetime bar. The person may be able to shorten any bar against reentry by working with a good federal defense lawyer who is familiar with immigration law.
