I have a pending criminal case which is from an illegal search by police officer. During a motion to surpress, my attorney and I found that the same officer had put my occupation down as "prostitute", and that I had several convictions for this as well. This is a flat out lie, and was done, I believe, in a malicious manner. Obviously, the convictions cannot be verified, they dont exist, my attorney checked into it, and I was never asked, nor gave them any indication of being a prostitute. I was working at a topless club at the time. The case is going to trial soon, and this would not look good to the jury. Could this be defamation? Thanks
