Default Have I waited to long to file for workers comp?
While about 25 weeks pregnant I fell down at work due to cutting oil on the floor of the machine shop. A spill had not been correctly cleaned up, and as a result I slipped and fell in the "saftey zone" on the floor. I immediatly went to the company nurse, and she told me I was fine and that I should just go back to work. Well I ended up calling my OBGYN who told me to make haste getting to the ER. I had contractions for 2 days and had to be given medication to stop them. The fall also aggrivated an existing medical condition with my back. I have been filing my missed time from work under my current FMLA intermmitent leave because my back has been a problem for me in the past so I just assumed that this was what I should have done. Now my employer is acting strange. They have been in contact with my FMLA carrier questioning my time missed from work and the "qualifying events" that have led to my leave. I am afraid they are fixing to try to either fire me or dock my pay. Now I am 39 weeks pregnant and my maternity leave has been denied by the STD insurer because they say that my employment has been terminated. Isn't this interesting? My HR rep says that she has no idea why this would have happened and that I have not been terminated. Now I am really stressed out about the whole issue. I am about to have a baby and I am worried about not having an income. Is it too late to file for workman's comp? Should my employer have had me do that when the injury happened? I wish I was more educated on workman's comp but I am not. I am doing research now to see what rights I have and dont have, but could really use some help determining what I should do from here.

How long you have to file a workers comp claim is state specific and you have not indicated what state you are in.
