Default Will the fun never end?
Illinois.
i was injured at work. i have had a knee surgery and injections on my knee. at this point my doctor has giving me permanent restrictions. they will not allow me to return to my regular job. my doctor sent me for a 2nd opinion about my knee pain, and the doctor i seen stated i should have another surgery, i spoke to my doctor, and he stated he didn't think it would help much, so i didn't have it done. well now the insurance company has stopped paying my ttd. they state i never showed up for the surgery, and now they aren't going to pay me ? the problem i have is i called to cancel the surgery, but the doctor office Say's i didn't. now it's a he said she said type deal, unreal, this company went 20 weeks without paying me, but finely they did, just another game. also i was wondering if anyone knew if i could file a civil lawsuit against my company, and the place where i got injured? thanks for any help.

No, you cannot sue your employer. The workers comp laws are written to protect both parties; you get your medical care paid for but the flip side of the coin is that you don't get to sue.

The circumstances where you can sue an employer for an injury covered by worker's compensation are very narrow - usually limited to cases where the employer intends the injury. There are circumstances where a third party may be liable for the injury.
