    Question Threatened with termination over personal relationships by family member employer

    The State of West Virginia.

    I began working for a family member in 3/05. I was in a relationship at the time and everyone was getting along pretty well.

    However, when I decided to leave the relationship, I moved closer to work. My employer/family member told me, specifically, that if I brought my ex to my new home OR if he moved in, she'd fire me. She's told everyone she'd fire me, including mutual friends and the other employees who work there.

    Now, I know we don't have a written contract and she can fire me or I can leave at any time, with or without notice on either part.

    Can she LEGALLY fire me, for a personal relationship which doesn't affect my job performance or the business in any way? If she does, what action can I take?

    Ah, the joys of working for a relative.

    Was the relationship or any aspect thereof, including breakup issues, affecting your work performance? Were you complaining of your relationship problems at work?

    No, the personal relationship wasn't affecting my work ability. I make sure that I leave my personal relationships at home, not take them to the office. However, she never liked my boyfriend, once she met him at a family function.

    Although I didn't discuss my relationship problems at the office...she's heard details from other family members. Our problems made her dislike him even more.

    So she told me, that once I moved out here, she'd fire me if I let him move back in (which I never will do) OR if I let him visit.

    Since splitting up, he and I get along better, but we will never be in a relationship. I wouldn't mind if he and his girlfriend (I get along with her) to visit sometime. However, if my family member found out, I feel all heck would break loose.

    Can she make good on her threat? Legally?

    A: You are correct.

    A: She can fire you for no reason or any reason.


    Q: If she does, what action can I take?

    A: Look for another job.
