Company is not sending refund - How to go to small claims court

Basically this is my situation. Back on sept 19th I purchased a set of headlights from a company named Coway. I recieved half my package and then I spent the next 3 months trying to get the rest of the package shipped. I was told/promised they would be arrive shortly. I even met the online dealer but to my surprise he was empty handed again. They promise everytime its in the mail this and that. All lies. Finally I was contacted out of the blue about 2 weeks ago from the owner of the company. He aggreed to send me a full refund and he even updated me to expect mail with the check in a few days. Well now im still with out the check and I call/email the owner an the dealer everyday with no answer or " ill have to look into it" I have many emails saved and have all receits. I want to bring this to small claims court possibly by the 4th month mark around jan. 18th. My questions are what is small claims court like, do i need a lawyer, I live in New York and the company is located in North Carolina. Please help thisi s ruining my friends christmas who layed out the money I simply just placed the order for him.

Go to North Carolina and sue them there in small claims court.

No I paid by money order... which was the owners reasoning as to why he was sending the refund not simply using paypal. It seemed to make sense 3 weeks ago but not I see it was just another lie. Anyay i still have the receipt and the confirmation it was mailed to coway.

Why did your friend need your help to make the order? Anybody can get a money order.

I did it for him because I had bought the lights from this dealer 6 months previous and everything went smooth i was very happy with the transaction so i told him ill get you the same thing and now its totally a different story.
