    Default Eviction-Roommate Dilemma

    I am a resident of FLORIDA and I rent an apartment from an apartment complex. I have been living there for almost 2.5 years. Mine is a double bedroom apt. so I have always had a rommate. My current roommate lost his job in the beginning of this month and couldn't come up with the rent.(He is not on the lease. Only I am on the lease) and he asked me for more time to pay the rent. I went to the office and told them that we couldn't pay till the 18th of December and they said it was fine. As a formality they served us a 3 day notice on the 11th saying that pay the rent by 14th or evict the apt but still said we could pay by the 18th.

    It is the 19th and my roommate still doesnt have the money and says that he will have it on the 28th. I will go talk to my complex to see if that is ok but I dont think they will consent to that.

    My question is, if they dont give us till the 28th, can they evict us immediately or do they have to serve us a 30 day notice?

    Can I evict my roommate since he hasn't paid the rent and neither is he on the lease or would that count as illegal eviction?

    Again, I am from Florida.

    If you don't pay your rent your landlord can evict you. They've already served you with notice.

    You can commence the eviction process against your subtenant / roommate, but your more immediate issue is paying off the rent you owe to your landlord.

    What if the roommate is in the lease as a occupant? The verbal agreement is that she pays all utilities but has not yet done so. Is there a time limit to give notice of eviction? Should I have or still can draw up a letter of agreement for the untilities? I am also in Florida.

    Your question is what? If this excuses you from having to pay your rent on time under the lease?
