I have filed a lawsuit against my next door neighbor in Delaware,for having more than two pets, and operating a dog-breeding business in her home. The deed restrictions do not allow this. The judge decided to allow the Civic Assoc. to take a vote to amend the deed restrictions to allow her operation to be allowed. That means that there is no protection if someone goes to court over a violation. A judge can allow a change in the deed restrictions in the middle of the court case. Is this Allowed? How is a person protected? She also put up a "barrier" that blocks our view. We are going back in to the court about this, and we are afraid that he will grant them a chance to change the restrictions again. How do we protect ourselves?
