Default Child Custody Litigation Over a Newborn
I am currently four months pregnant, and do not plan on naming a father when child is born on birth certificate.

My ex-boyfriend is positive that the child his and says he is going to fight me for joint physical custody even though it may not be his child. He is a control-freak, and I don't want him to be the father.

I was told after I give birth I need to file for custody, is this true and does the child have to be a certain age before a paternity test can be administered?

Until paternity is established, you have custody by default. A custody action may be commenced as part of a paternity action.

Default Child Custody
I have a similar situation that is posted under Susie. My baby is 3 months old and I am going through hell because he is the same way... a control freak and wants to be together to be a family. I am told to be careful, because nowadays judges don't like when mothers try to keep their kids from seeing their fathers if there is no just cause. I am going to attempt full custody for my reasons listed in my story. But, good luck...it hasn't gotten any better for me and I do wish he wasn't the father either.
