    Default Car Title Problem

    I bought a used car from a private party for $7000 almost 5 months back .The seller has still not transferred car title to me. The seller has disappeared. I went to the small claims court in california but judge said he cant help me with the transfer of title. I have bill of sale along with other documents.

    Any suggestions on how to get the title transferred.

    Seller promised to give the title in a week , I thought he was trustworthy , afterall I had the car .

    Are you sure the person actually owned the car? Have you considered filing a police report?

    ya i tried filing police report but they told me to goto courts. The person owns the car along with his grandmother . Both there names were on the title

    Cant contact her .. tried but no answer. Also car's registration expired.

    Consider suing grandma and grandson, and if you can't locate the son seek court permission for substituted service. Given the value of the car, I would consider suing for a refund in small claims court; but if you're sure you want it you can either hire a lawyer or try to bring a lawsuit in Superior Court by yourself to demand transfer of the title.

    i went to the small claims court, but he didnt show up. The judge awarded me $1500 , i tried to recover car cost but he said that i am still using the car. So he cant reward me the cost of the car. Should i go to small courts again ?

    The best way of avoiding problems like this is to always have the owner(s) accompany you to the DMV to register it. Obviously, it's a minor hassle but for a $7000 car, they will do it. I insisted that my son do that a number of years back and it saved him a great deal of time and trouble.

    I woudn't insist on that for a $700 motorcycle...but I wouldn't buy anything unless I received the title.
