The problem is much larger than what I am describing. I am just describing the boundary issues with a little bit of background. There is a state road that sometime in the past 40 years the state changed the route by a couple of hundred yards. The county was then given resposibility for the abandoned section of the old road. It is a portion of the old road that is in dispute.
In August of 1985 the county deeded half of the right-a-way (33 feet) to to an Assembly of God church, for the sum of ten dollars. I have seen the warranty deed, registered at the clerks office. Now in relation to another dispute the county attorney is stating that the deed from 1985 (executed by him believe it or not![]()
) is not valid, and that the property is not owned by the church. In the past couple of months the church placed corner posts inside the property lines (you can still see the divider line in the center of the asphalt road). Someone complained and the county road dept came out and removed the posts. What if any recourse does the church have? BTW small town and NONE of the local attorneys are willing to take the case.
