Default How to reopen a closed case
Hi,
I was woundering if a person had a comp case and settled it if it can be reopen if u have to have more operation done?

i had disk operatiaon in 2001 and settled my workman case in 2005 for it now i find out i need another operation after 5 years and this will take place in dec of 2006 what i need to know is a person able to reopen a claim if u had signed off on it from before not knowing u were going to run into prob later on down the road, r can a person place this for billing under your own insurence claim i did win my case from before with the help of my work comp lawer, but he is out of town for a few weeks and i need to know this as soon as possable thank you for your time i will await for your anwer

It's going to depend upon a number of things, including whether there was a prior settlement of your case and its terms, and whether your doctors can relate your current condition to the work-related injury from that may years ago. You previously had the help of a worker's compensation lawyer, so your best first step would normally be to contact that lawyer to determine your current rights. As he's out of town, check to see if his office has arranged for another lawyer to cover for him until he returns.
