Question Workers Comp and Remarriage
I live in Indiana. and under the w/c law upon remarriage there is supposed to be a lump sum payed out . my husband was killed in June of 2003 . April 2004 I recieved a paper from the w/c people for me to sign that if I remarried prior to 2008 that I forfiet my comp every month and also forfiet my lump sum . I did sign this paper naturally still in mourning for my husband . I forgot all about signing this paper until I did remarry and notified them and they sent me a copy of the paper I signed . telling me that I would not recieve any more payments from them . my question is this .... why would they have me sign something like that knowing I was still in mourning and that I would no doubt sign it . is this legal ? thanks for your time ....

They did it to save money. That's what insurance companies do.

Without seeing the paperwork my reaction is "probably", but I would suggest taking the document you signed to a workers' comp lawyer in your state so you can be sure.

My question is why if you remarry in 5 years? I could see if you did it in 2 or less, but hey, that is just me.

Hmmm, I would ask the lawyer about someone signing something under emotional duress?
