Default Paternity Questions After Long Separation
I live in florida, when I was 18 I married a women who was older than me. after 3 months she stole everything from me and left to live in mexico where she is from.I am now 33 will be 34 in jan. and 16 years later she is trying to collect child support on 4 children that are not mine,as far as I know she was not pregnant when she left and even if she was only one may be mine,we are still leagaly married what are my rights and can she collect the child support on children that are not mine?

If you didn't have any children when you were together, and we're not talking about quadruplets, it seems safe to assume that not all of the kids are yours.

You say she's pursuing child support - this is through the Florida courts? Have you commenced divorce proceedings?

it has not reached the courts yet,i got a letter from the IRS they want to set up a meeting to discuss it. I don't even know if any of them are mine. If by chance one is mine can they get back child support even though she did not tell me she was preg. and left me 16 years ago?

The IRS wants to discuss what, exactly? The IRS will collect child support - raising the question of whether she is trying to enforce a support order she obtained in Mexico. I would suggest contacting a local lawyer about initiating divorce proceedings, through which you may be able to get a local judicial ruling that no children were born of the marriage.

let me correct myself. the letter came from the florida department of revenue and child support enforcement. She is now in florida with the children, there has not yet been a court order for child support. I think she is on public assistance and named me as the father of her kids and since we are still married the state is coming after me for the support.but I was only with the women for three months before she left me, 16 years ago I don't even think any of the kids are mine.

She doesn't need to name you as the father - you're her husband and thus are presumed to be the father.

Tomorrow morning, hire a family lawyer and start proceedings to (a) divorce her and (b) disestablish paternity.

I left a message with the child support enforcement with the case # to call me back and set up a meeting , should I talk with an attorney before I talk with them?

My suggestion was: Tomorrow morning, hire a family lawyer and start proceedings to (a) divorce her and (b) disestablish paternity.

if one of the kids is mine....can they come after me for back child support for the past 16yrs? if i was never told about the child or had contact with the mother for that length of time?
