Default Not the Bio Father
Hi I need some help, I got married last year because my gf was pregnant, she told me the baby was mine, I sign the birth certificate, a few days ago she told me the baby it's not mine and she only did that so she can get child support out of me, and she told me that she would never let me take a paternity test.
can she actually do that?
do I have to pay child support even if I prove with a DNA test that I'm not the biological father?
what kind of lawyer do I need?
the child was born in Oklahoma, now I live in Texas.
I would really appreciate some help.

At this point it isn't certain that the child is not yours. If it were not a biological possibility, after all, you wouldn't have believed the mother in the first place. Are you still married to the mother? Do you have access to the child?

ok here's the thing, I'm like 90% sure the baby it's not mine because now I know she kept seeing her exhusband even after we got married, and her exhusband is kinda crazy, he tried once to commit insurance fraud, so I really believe that he told her to marry me just to get money out of me.
So far we still married but we don't live together anymore, she went back to Oklahoma and I'm in Texas now.
I'm worried because I don't wanna pay child support for a kid that is not even mine and he's 6 month old, so I would have to pay 17 years of child support.
And the other question, well I guess I still have access to the baby, I just have to drive all the way to Oklahoma.
what do you think I should do?
get divorced and then deal with this or remove my name from the b/c before the divorce?

As the mother and child are in Oklahoma, and the child was born in Oklahoma, the custody and paternity belong in Oklahoma. I would suggest consulting an Oklahoma family lawyer about the case, and that state's protocol to dispute paternity within the context of divorce. Unfortunately I cannot find a source of that information online.

Being in Texas, if there is any question of paternity, you are entitled to a paternity test, especially if you signed the AOP. Hire an attorney and you can get a court order to make her comply. Jeff
