    Default Father Has Filed PPO

    The father of my child has filed an order of protection on himself and my 5 year old child from me recently.

    Here is what had happened and I am needing any kind of advice. My child's father and I have never been legally married, never signed a recognized parentage form, nor he has paternity. We have never been to court for anything with eachother and this hearing that is coming soon will be my first time having anything to do with court. I know he has no right to have my child whenever he wants unless I say when he can.

    She has attended kindergarten in my district and living at home with me since September 13'. He has her over the weekends while attending kindergarten. This past weekend, he tried to pick my child up Friday when I have told him that he could not pick my child up due to compromising issues prior to this past weekend. He showed up anyways, but we were not home. My mother who I live with had informed me that he is going to pick my child up the next day. I texted him to not pick her up the next day. No response from him.

    The next morning, he showed up. My brother had opened the door for my child's father and went back into his room. I told him to leave and reminded him that he cannot pick her up. He would not leave until he had my child. We argued for a while repeating the same thing telling him he needs to leave. I have threatened to call the police and out of fear I have threatened to "beat him up" if he does not get out of the house and leave. I stood infront of the door making sure he does not take my child with him.

    He picked up my child and hit and shoved me out of the doorway and opened the door. I got infront of the door with the door opened and he pushed me leading to outside since I was in the way and I defended myself fighting back. He made it to the driveway with my child and that was when I stopped and knew I couldnt do anything.

    She had missed days of school and I received an email from school stating that there has been a request of transfer to a school nearby his location and asked if my child and I have moved. I replied I did not request such a thing. She replied that he had legal documents that he could enroll her. I know I did not sign any recognition of parentage or anything like that where he would have legal rights to do so, so I called the school he transferred her to and spoke to the principal to find out what document he has that he was able to enroll her. The principal had told me that there's a court order that I am not able to call or enter into the school. I was shocked. I did not know what was going on.

    I called around to find out what it could be and found out it was an order of protection on my child and himself because (in his statement) he tried to take his child and I had threatened to beat him up, abused him, and would not let my child go with him from my child's own will screaming and crying, "I want daddy." And multiple times he has put into his statement that he is afraid that I will take the child away and hide my child from him. He also stated about things in the past why and how he is a good father and how I bad mouthed him and other things that does not relate this "abuse." He requested that I will only get supervised visitation on certain days and time. Will this order of protection hearing be questioned strictly on this "abuse" situation or will we also be questioned on my child/custody?

    Any advice is appreciated. Thank you.

    Are you saying that he is not legally the child's father? That no paternity has been established? No child support ordered or anything?

    Get an attorney ASAP!

    They all need counseling. Physically fighting the other parent when they are holding your child has got to be terrifying to the child. What a sad situation.

    Since 5 year olds are not grown by the process of "just add water", where was she until September 2013?
