    Default Do grand-parents have rights in adoption

    My wife wants to adopt my child, my kids biological mother is deceased. The grand-parents aren't very happy about it so what I'm wanting to know is...since my son's mother is gone do the grand-parents have any rights here? I'm afraid they're going to try and stop this from happening. BTW, I live in Arkansas.

    You wife may adopt your children and the grandparents are able to petition the court for visitation unless you come to some sort of agreement, given everyone is found to be fit. Any social security benefits will remain the same although they could inheirit from your wife also along with any biological children you share. You might consider guardianship for your wife instead insofar as practical matters. If your wife was to adopt and then you were to divorce, she would have equal rights and responsibilities for the adopted children as for biological children including custody and child support, so you could see where this could lead were a divorce to occur.

    It is not just a case of grandparent's rights, but that they lost their daughter also and adoption is like losing her again even though she will always be their daughter and your child's mother, it is an emotional loss.
