    Default My Ex Left My Son with Grandparents and Moved Out of State

    My question involves a child custody case from the State of: TEXAS
    I have a son me and his mom never got married but I did sign the birth certificate and the acknowledgment of paternity .
    She moved 2 years ago to Georgia she calls him maybe once a month. I would like to get full custody if possible he's 8 years old now.
    Do I have the right to go pick him up and take him with me until the court decides who is having custody?
    Would that make it easier for me to get full custody because she moved and left him behind

    I see him every other weekend starting on Fridays and I take him back on Sunday
    and no there's no other orders

    Ok. File immediately for custody, and request temporary custody while the issue is going through the courts.

    I agree, but since he has not challenged the child living with the grandparents for two year now, his odds of getting temporary custody may not be good...and he will have to expect that the grandparents will file for custody as well. So mom won't be his only opponent. He still has a reasonable shot at winning, but its not going to be a slam dunk...particularly if the child will have to change schools to live with dad.

    The way he worded things and the fact that he knows that she only calls about once a month make it seem that way to me. Surely he had to suspect something if he never laid eyes on mom for two years...plus the child is old enough that its unlikely that the child didn't spill the beans as well.

    now I already have a lawyer and I'm fighting to get his full custody.
    grandma passed away about 3 months ago but, now the great grandma and my ex girlfriend want custody of my son.
    My son's mom just received the letter from the court now, she's coming back to fight custody but, she has no job or no stable place to live and a new born baby. what are the chances of her grandma which is my son's great grandma about 80 yrs. getting full custody?
    He's not doing good in school he leave the house and goes to wherever he wants they have called the cops like twice because they couldn't find him
