Recieved a letter that i am gong to be sued by Visa
Hi I was in collections about a year ago over a visa debt and my family and i were being harassed by this collector by crank calls calling me and my family names yelling at my family if they would tell her i wasn't home etc. Finally when i got to speak to a manager there and he apologized and said they would take my file out of their system and i would be able to handle it when i could afford it that was it no contact since then i moved out when i got married and that was that. Then yesterday i was visiting my parents and they told me i got a letter in the mail i open it and it is from law office stating that their client (visa) is going to sue me if i don't pay my debt ($2000) in dollars in ten days and i will have to pay for court charges and garnish my wages and take my property. I don't own anything just have a joint bank account with my husband. What can i do and how can i fight this andy advice? I am so scared because i have on child and another on the way and my husband works paycheck to paycheck i don't know what to do?
If you are not contesting the validity of the debt, your principal choices are (1) pay the debt, (2) let them sue and probably end up with a judgment against you, (3) attempt to negotiate a reduction of the debt in return for your immediately paying off the reduced debt, or (4) bankruptcy.
That depends upon their policies, what they think they could recover in court, and what they believe their odds will be of recovering any money on the judgment. You can contact the law office and ask if they would agree to some form of installment plan to pay off the debt.
