Default Ex Cop with Issues in South Carolina
I feel so helpless. I was at my best friends house for a halloween party. A group of us decided to go downtown. This is my statement to the police dept. This guy is an ex-cop and ex-marine. He came to the halloween party dressed as a DEAD MARINE. He has filed a warrant for Assault/Simple assault and battery. I have 2 witnesses that were in the van with me and are going to testify that he was acting crazy and over the top....My court date is Thursday and I don't know what to do...I can't afford a lawyer.


I had no reason to harm Mr. [Name Removed]. He seemed to be a very nice gentleman at the party and on the way downtown. I had never met him before the party.

His demeanor during the ride home terrified and confused me. He was upset about seeing an ex-girlfriend downtown. [Name Removed] kept lunging over the back seat to jab and point and yell at [Name Removed] in the front passenger seat. I was already crammed up against the back of the Drivers seat (in the middle seats) trying to stay out of his reach.

[Name Removed] seemed out of control. I tried to reason with him asking him why he was so upset and he told me to “shut the **** up – that this was none of my business”.

He proceeded to turn on me calling me names and threatening me. [Name Removed] told him to leave me alone that he didn’t even know me, and then he started arguing with [Name Removed] again.

He kept lunging over the back seat, and then finally started trying to come through the center isle of the seat. We were maybe 2 minutes from the house.

I only grabbed his arm trying to stop him from climbing on top of me and hurting me or someone else. I am only 5’3” and 130lbs….he is at least 6 ft and 200 lbs (ex-cop, and ex-marine). Any damage to his arm is proof of the force that he was using against me to get over the seats.

I in no way had any intent of inflicting pain on [Name Removed]. I was terrified of the way he was acting and was instinctively trying to protect myself and anyone else that he was trying to harm.

Ask for a court-appointed lawyer. It sounds like you should have lots of witnesses to back up your story.
